As part of your purchase, you may have requested custom delivery and installation services. Or, SafeandVaultStore.com may refer you to a third party web site or provide you with names of companies that you may directly contact for quotation and contracting of delivery and installation services. Those delivery and installation services are governed by these Terms and Conditions of Use for Third Party Delivery Services, so please review them carefully.
SafeandVaultStore.com, LLC ("SafeandVaultStore") is a subsidiary of Allied Safe and Vault Co., Inc. ("Allied Safe"). These Terms and Conditions constitute the binding agreement between you, the user, and SafeandVaultStore and Allied Safe, including your use of SafeandVaultStore.com (the "Website") along with the products and services offered through the Website. The Website is offered to you with the following terms, conditions, and notices contained herein, as well as the privacy policy (collectively, the "Terms and Conditions"), along with the Website's Terms of Use. Your use of the Website, and your purchase of products or services from Allied Safe or SafeandVaultStore, constitutes your agreement to the Terms and Conditions. We may amend these Terms & Conditions at any time. The continued use of any SafeandVaultStore services or the Website following the posting of changes to the Terms and Conditions mean your acceptance thereof.

1. Installation Services. When you request special delivery and installation services of a product sold by SafeandVaultStore, we will attempt to provide you a list of third-party providers of delivery and installation services ("Delivery and Installation Professionals") in your area. You may then contract directly with the Delivery and Installation Professionals. In the rare event that SafeandVaultStore contacts the Delivery and Installation Professionals for you, the terms and limitations contained herein shall apply to any services provided.
We do not guarantee that there are Delivery and Installation Professionals in your geographic area that are either capable or willing to complete your delivery and installation needs. We make no, and explicitly disclaim any, guarantees or representations regarding the skills or representations of such Delivery and Installation Professionals. SafeandVaultStore does not endorse or recommend the services of any particular Delivery and Installation Professionals. It is entirely up to you to enter into a direct contract or otherwise reach agreement with Delivery and Installation Professionals and we do not guarantee or warrant their performance on the job or the outcome or quality of the services performed. The Delivery and Installation Professionals are not employees or agents of SafeandVaultStore, nor is SafeandVaultStore an agent of the Delivery and Installation Professionals. Your rights under contracts you may enter into with Delivery and Installation Professionals are governed by the terms of such contracts and by applicable federal, state, provincial and local laws. Should you have a dispute with any Delivery and Installation Professionals, you must address such dispute with the Delivery and Installation Professionals directly, AND YOU HEREBY AGREE TO RELEASE SAFEANDVAULTSTORE (AND OUR OFFICERS, DIRECTORS, AFFILIATES, EMPLOYEES, AGENTS AND AFFILIATED COMPANIES, INCLUDING ALLIED SAFE) FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH DELIVERY AND INSTALLATION PROFESSIONALS.
2. Information You Provide To Us. Upon purchase of any SafeandVaultStore products or services, you may be prompted to disclose certain information about your delivery and installation requirements. In the event you choose to provide SafeandVaultStore with personally identifiable information about yourself, by providing this information to us, you expressly consent to being contacted by us and our parent companies (including Allied Safe), subsidiaries and affiliates via phone, fax, email, mail or other reasonable means, at any of your contact numbers or addresses, even if you are listed on any federal, state, provincial or other applicable "Do Not Call" list, in order that we may provide the delivery and installation services for which you have provided your personally identifiable information. 3. Indemnification. YOU AGREE TO INDEMNIFY SAFEANDVAULTSTORE, AND ITS SUBSIDIARIES, PARENT COMPANIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CO-BRANDERS, AND OTHER PARTNERS AND HOLD THEM EACH HARMLESS FROM ANY AND ALL CLAIMS OR DEMANDS, INCLUDING ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING FROM YOUR USE OF THE DELIVERY AND INSTALLATION PROFESSIONALS, YOUR USE OF THE SAFEANDVAULTSTORE WEBSITE, YOUR VIOLATION OF THESE TERMS AND CONDITIONS OR OTHERWISE ARISING FROM YOUR VIOLATION OF ANY RIGHTS OF A THIRD PARTY.
4. Warranty Disclaimer. You acknowledge and agree that the Delivery and Installation Professionals' services are provided to you on an "AS IS" basis without any warranty whatsoever, and your sole and exclusive remedy, and SafeandVaultStore’s sole obligation to you or any third party for any claim arising out of your use of the Delivery and Installation Professionals' services, is that you are free to discontinue your use of the Delivery and Installation Professionals' services at any time. EXCEPT AS EXPRESSLY SET FORTH HEREIN, SAFEANDVAULTSTORE EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND YOU AGREE THAT SAFEANDVAULTSTORE SHALL HAVE NO LIABILITY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT), EXEMPLARY OR PUNITIVE DAMAGES (EVEN IF SAFEANDVAULTSTORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF INFORMATION PROVIDED BY YOU TO SAFEANDVAULTSTORE OR ANY CONSEQUENCES WHICH FLOW FROM IT. SOME STATES AND PROVINCES DO NOT ALLOW LIMITATIONS ON OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH STATES AND PROVINCES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. These Terms and Conditions will inure to the benefit of SafeandVaultStore’s successors, assigns and licensees. If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable, for any reason, by any court of competent jurisdiction that provision shall be modified in order to make it enforceable, while maintaining the spirit of the provision. Alternatively, if modification is not possible, such provision shall be stricken and shall not affect the validity and enforceability of the remaining terms. The failure of SafeandVaultStore to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the suggested SafeandVaultStore Delivery and Installation services or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect. These Terms and Conditions are governed by the laws of the State of Washington as such laws are applied to agreements entered into and to be performed entirely in the State of Washington and between Washington residents. You agree to submit to jurisdiction in the state of Washington and that any claim arising under these Terms and Conditions will be brought solely in a court of competent jurisdiction in Spokane County, Washington.
